On-call backpay WIN at Mackay Regional Council

The Congratulations to members at Mackay Regional Council who raised concerns to our Union about Council not giving on-call staff all the options available in the Determination when on-call on a public holiday.

The end result? Staff that have been on-call during public holidays, have been paid an additional day’s pay at ordinary rates and not been given the option to accrue a day’s annual leave will now be back paid annual leave loading of 17.5%. Staff that are impacted will be back paid to the commencement of the Determination agreement and Council is now developing a mechanism within their payroll system to provide you with all the options within the 2022 Determination agreement, as per below.

23.1.5. An employee whose period of required availability includes or coincides with a public holiday shall be paid an additional day's pay at ordinary rates for each public holiday during the period of availability or, at the employee’s request, have an additional day added to their annual leave accrual. If these additional days are not utilised within six (6) months from the date of accrual the Council at its sole discretion, may elect to pay the additional day’s accrual out to the employee at ordinary time.
