Huge backpay win and EBA5 certified

$300k + backpay win    

In the next pay run, dozens of any 5 in 7 library, gallery and museum staff will be receiving backpay. Many of our members were receiving incorrect penalty rates dating back to 2017. In total the backpay equates to over $300k. The Services Union won this backpay argument on appeal at the Industrial Court.


Not only have we fixed up the backpay for many of our any 5 in 7 members but we have been able to improve penalty rates at the weekend going forward. From here on in, every Stream A (Indoor) employee working any 5 in 7 will get time and a half on Saturday and double time Sunday. A huge win and every member at Moreton Bay Regional Council (MBRC) should be proud!

On top of this our Union was successful in getting 172 MBRC employees re-issued over 7000 hours of personal (sick) leave in total. This came about due to Council applying 2014 Award conditions even after it was replaced by the 2017 Award!

EBA5 Certified

Congratulations to every member at MBRC!

On top of the improvements to any 5 in 7 penalty rates, our Union has been able to achieve the following in EBA5:

  • 4% for Year 1 (1 July 2022).
  • 4% for Year 2 (July 2023).
  • 3.5% or CPI capped at 4% for Year 3 (July 2024).

Redundancy clarity – The new clause has taken out the CEO’s discretion to approve redundancies, which means that if you are made redundant and there are no suitable alternative jobs for you, then you will be entitled to receive up to a maximum of 58 weeks redundancy.

Natural Disaster Leave – The new clause makes it clearer that the CEO can determine that a natural disaster has occurred rather than waiting for the disaster to be declared. Making it clear that Council does not have to wait until the ‘declaration of a disaster situation’ is a positive improvement to the current clause, particularly when we think about the 2022 floods.

RDO Banking – Increase in staffs’ ability to bank RDOs up from seven days to ten days.

Parental Leave – Superannuation will now be paid on the paid component of parental leave. Introduction of paid partner leave of 1 week.
