Direct Care Resources EBA UPDATE

Our Union is by your side through the process of bargaining for a new Enterprise Agreement with your employer Direct Care Resources. We want to provide you with a brief update on the steps that are now underway following the ballot on the proposed Enterprise Agreement.

On 29 August 2023, DCR lodged their application for approval of the agreement to the Fair Work Commission (FWC). On 5 September 2023, our Union submitted our response to the application to the Fair Work Commission on the basis that we do not believe that the proposed agreement meets the Better Off Overall Test (BOOT) requirements due to the incorrect classification of your role.

Next steps

The FWC will now review the proposed agreement and commence their analysis. The analysis is generally undertaken very quickly, usually within a few days. The FWC will likely seek further information from both parties and we do expect that the matter will proceed to hearing.

We do not have a specific timeline for this process but the matter will now progress quickly. We will keep you updated throughout the process.
